Copyright framework

The following four factors are used to determine if a use is fair:

  1. The purpose of the use. Is it educational? Commercial?
  2. The nature of the copyrighted work
  3. The amount of the material used (the greater the amount copied, the less likely it is fair use)
  4. The effect of use on the potential market for or value of the work

Three Helpful Questions for Transformative Use:

1. Does the new work add something new to the original work?

2. Does the new work have a further purpose or different character than the original?

3. Does the new work alter the original work with new expression, meaning or, message?
